Terms of service

These Terms of Service govern access to and use of punkoutfit.shop and purchases made through our online store.

Throughout these Terms, “we”, “us” and “our” refer to punkoutfit.shop where appropriate.

“You” and “your” refer to the individual accessing our website or purchasing products from us.

By accessing our website or placing an order, you agree to these Terms to the extent enforceable under applicable law.

Nothing in these Terms removes or reduces statutory consumer rights that cannot legally be excluded.

Eligibility to Use the Website

You may use our website only for lawful purposes.

By submitting an order, you represent that you have legal capacity to enter into the relevant transaction or are otherwise legally authorised to do so.

You must not use the website for fraudulent, abusive or unlawful purposes.

Ecommerce Platform

Our store may use Shopify technology and compatible third-party services to provide ecommerce functionality, hosting, checkout, payments, applications and other services.

Use of certain separate services may additionally be subject to terms imposed by the relevant provider.

Product Information

We make reasonable efforts to provide accurate information concerning products.

Product information may include descriptions, photographs, dimensions, materials, colours, sizes, features and other relevant details.

Minor differences may occur because of screen settings, photography, lighting, manufacturing tolerances, natural material variation or reasonable product changes.

Nothing in this section permits goods to materially differ from their contractual description or otherwise fail to satisfy mandatory consumer standards.

Availability

Products are offered subject to availability.

We may modify our product range, limit quantities, discontinue products or update availability from time to time.

Placing an item in a shopping cart does not reserve that item.

If we cannot fulfil an accepted order, we will take appropriate action, which may include cancelling the affected item and refunding any corresponding amount already paid.

Prices

Prices are displayed through our website and checkout.

We may change prices at any time before an order is accepted.

Where a pricing error is obvious and could reasonably have been recognised as an error, we may contact the customer before fulfilment and provide appropriate options.

Customers will be shown the amount payable before submitting an order.

Orders

Submitting an order constitutes an offer to purchase products subject to these Terms.

We may send an automated acknowledgement after an order is submitted.

An automated acknowledgement does not necessarily constitute final acceptance of an order.

We may decline an order for legitimate reasons including:

  • Unavailability;
  • Payment failure;
  • Suspected fraud;
  • Materially incorrect customer information;
  • Obvious pricing or listing errors;
  • Delivery restrictions; or
  • Legal or regulatory requirements.

Where we decline an order after receiving funds, amounts owed to the customer will be reimbursed.

Customer Information

You agree to provide current, complete and materially accurate information necessary to process your order.

You are responsible for reviewing delivery details carefully before submitting an order.

If you discover an error after checkout, contact:

info@punkoutfit.shop

We will make reasonable efforts to assist, but changes cannot be guaranteed after fulfilment or dispatch has begun.

Payment

Available payment methods are displayed at checkout.

Payment may be processed through third-party payment-service providers.

You authorise the applicable payment provider to process the amount presented at checkout when you complete the purchase.

We may delay or cancel fulfilment where payment cannot be authorised or where fraud screening identifies a legitimate security concern.

Contract Formation

A legally binding contract for goods will arise according to the information presented during checkout, our order communications, these Terms and applicable law.

Where an order contains multiple products, each product may in appropriate circumstances constitute a separate part of the contract.

Delivery

Standard shipping through punkoutfit.shop is free on all orders.

Our estimated standard delivery time is 15–20 calendar days, unless otherwise clearly stated before purchase.

UK rules require online traders to disclose delivery arrangements and anticipated delivery timing before the customer orders, and goods must generally be delivered within 30 days unless another timeframe has been agreed. Our stated 15–20 calendar-day timeframe therefore forms the delivery expectation for ordinary orders unless another period is expressly agreed.

Further information appears in our Shipping Policy.

Delivery Delays

Delivery estimates may be affected by events outside our reasonable control.

Where a delivery is delayed, we will handle the matter in accordance with applicable contractual and statutory obligations.

Nothing in these Terms removes any statutory right that may arise where goods are not delivered at an agreed time.

Risk and Ownership

Risk in goods passes according to applicable consumer law.

Where a carrier offered or arranged by us delivers goods to the customer or another person identified by the customer to receive them, risk will generally be determined according to applicable statutory rules.

Ownership may be subject to successful receipt of full payment.

Cancellation Rights

Consumers purchasing eligible goods online generally have a statutory cancellation period.

Subject to applicable exceptions, customers ordinarily have 14 days after receiving their goods to notify us that they wish to cancel and then a further 14 days to return them.

Detailed procedures and exceptions are described in our Return and Refund Policy.

Faulty Goods

Goods must comply with applicable contractual and statutory requirements.

If goods are faulty, not as described or otherwise non-conforming, customers may have statutory rights including rejection, repair, replacement, price reduction or refund depending on the circumstances.

The Consumer Rights Act 2015 provides a short-term right to reject qualifying faulty goods, normally subject to a 30-day period, together with further remedies in relevant circumstances.

Our policies do not replace those statutory remedies.

Intellectual Property

Unless otherwise stated or owned by a third party, website content made available through punkoutfit.shop, including original text, graphics, layout elements, store branding and other original material, may be protected by intellectual-property law.

Nothing in these Terms grants users ownership of our intellectual-property rights.

You may use the website for ordinary personal shopping purposes.

You must not reproduce, exploit, distribute or commercially use protected website material without permission where such permission is legally required.

Third-Party Intellectual Property

Certain names, logos, software, payment systems, applications or other material may belong to third parties.

All relevant third-party rights remain the property of their respective owners.

Prohibited Conduct

You must not knowingly use punkoutfit.shop:

  • For unlawful or fraudulent purposes;
  • To distribute malware or malicious code;
  • To attempt unauthorised access to accounts or systems;
  • To interfere with website security;
  • To harvest personal information unlawfully;
  • To impersonate another person;
  • To submit fraudulent payment information;
  • To engage in abusive automated activity;
  • To violate intellectual-property rights; or
  • To interfere materially with other customers' use of the website.

We may restrict access where reasonably necessary to protect the website, customers, systems or legal rights.

Customer Reviews and Submitted Content

If functionality allows customers to submit reviews, comments, photographs or other content, the customer must have the right to provide that material.

Submitted material must not be unlawful, defamatory, fraudulent, malicious or infringing.

Where legally permitted, we may moderate or remove content that breaches these standards.

Submitting content does not transfer ownership beyond any rights reasonably necessary for us to display, administer or use the submission according to the context in which it was provided.

Third-Party Links and Services

punkoutfit.shop may contain links to or integrations with independent third-party services.

Those services may have their own terms and privacy practices.

We are not responsible for an independent third party merely because a link to that party appears on our website.

This does not affect responsibility that cannot legally be excluded.

Website Availability

We aim to maintain reasonable availability of our website but cannot guarantee uninterrupted operation.

We may temporarily suspend, update or maintain parts of the website where reasonably necessary.

We will not seek to exclude liability where doing so would be unlawful.

Accuracy of Website Information

We may correct typographical, technical, pricing, inventory or other website errors when identified.

A correction will not be used to deprive a customer of a statutory right arising from an already binding contract.

Limitation of Liability

Nothing in these Terms excludes or limits liability where exclusion or limitation would be unlawful.

In particular, nothing is intended to exclude or limit liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or statutory consumer rights that cannot legally be restricted.

For losses that may lawfully be limited, our responsibility will be assessed according to the contract, the circumstances and applicable law.

We do not seek to exclude responsibility for losses that are a foreseeable consequence of our breach where the law does not permit such an exclusion.

Indemnity

Nothing in these Terms requires a consumer to indemnify us in circumstances where doing so would be unfair or unenforceable under applicable consumer law.

Users remain responsible for losses caused by their own unlawful use of the website to the extent permitted by law.

Privacy and Data Protection

Use of personal information is governed by our Privacy Policy.

The Privacy Policy explains how information may be collected, processed, disclosed and retained in connection with punkoutfit.shop.

Electronic Communications

By interacting with our website, you acknowledge that order confirmations, receipts, customer-service messages, policy information and other communications may be provided electronically where legally permitted.

Marketing communications are subject to separate applicable consent and opt-out requirements.

Force Majeure and Events Beyond Reasonable Control

We will not be responsible for a failure or delay caused solely by circumstances beyond our reasonable control to the extent permitted by law.

Such events may include severe weather, transport interruption, carrier disruption, governmental action, infrastructure failures, industrial disruption or other extraordinary events.

This section does not remove mandatory consumer rights, including rights relating to delayed or failed delivery.

Severability

If a provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be interpreted or severed to the minimum extent necessary while the remainder continues in effect where legally possible.

No Waiver

Failure to enforce a contractual right immediately does not necessarily constitute a waiver of that right.

Entire Agreement

These Terms, together with applicable policies, product information and checkout information, form the relevant contractual framework for purchases through punkoutfit.shop, subject always to mandatory law.

Nothing in this section limits liability for fraudulent misrepresentation or prevents consumers from relying on statutory rights.

Changes to These Terms

We may update these Terms from time to time.

Changes will generally apply prospectively and will not retrospectively remove contractual or statutory rights relating to orders already entered into.

The current version will be identified by its “Last Updated” date.

Governing Law and Disputes

These Terms are intended to operate consistently with applicable UK consumer law.

Nothing in these Terms deprives a UK consumer of mandatory protections available under the law applying to them.

Any dispute will be subject to the courts and jurisdiction available under applicable consumer and procedural law, including applicable rights of consumers in England and Wales, Scotland and Northern Ireland.

Before commencing formal proceedings, customers are encouraged to contact us so that we have an opportunity to consider and resolve the issue.
